 2260 motorcyclists were killed in 2005 because their motorcycles were not as visible as an automobile, per the 2005 calspan motorcycle lighting study data. therefore, the nhtsa minimum safety performance requirements for motor vehicles, specifically motorcycles, (summary description of the motor vehicle safety standards, title 49 code of federal regulations part 571) are inadequate to enhance the conspicuous of the motorcycle on the public roads so that its presence is perceived either in daylight or in darkness, or in other conditions of reduced visibility, thereby subjecting the motorcyclist to unreasonable risk of death and injury as a direct result of the misuse of the motorcycle headlight for the purpose of conspicuous. fact: the motorcycle represents less than one-third the profile of the automobile yet its lighting system, at best, does not allow it to be even as visible as the automobile. *tr
