 On monday 2 may 2011 at approx. 1645, i was operating my 2005 hyundai xg-350 l in the cvs parking lot on columbia pike in arlington, virginia. i pulled slowly into a parking space in front of the building. while my foot was on the brake pedal, the vehicle suddenly accelerated speed toward the building. i depressed the brake pedal firmly but the vehicle continue forward over a parking berm and curb stone before striking the building. damage to the vehicle was extensive. the building was also damaged and two cvs employees reported suffering minor injuries from the incident.

 Tl*the contact owns a 2005 hyundai xg350. while driving approximately 70 mph the vehicle started to jerk. the vehicle was taken to the dealer where the technicians stated there was a loose pin in the throttle body sensor. the technicians tightened the pin; however, the vehicle continued to jerk after the repairs. prior to the failure occurring the dealer replaced the transmission for an unrelated failure. after the replacement of the transmission the jerking motion in the vehicle recurred. the vehicle was taken to an independent mechanic who stated that the transmission converter would slip out of gear and would not stay engaged. the contact stated that the warranty was valid; however, the dealer stated that until a service engine light illuminated they could not repair the failure because the computer was not reading a failure code. the vehicle was not repaired. the approximate failure mileage was 90,000.

 2005 xg350 has had two specific problems related to engaging car in drive and acceleration. when car has been sitting overnight or for a prolonged period of time and it is placed in drive, the car just sits there in excess of 15 seconds and then transmission clunks into gear and starts going. this problem occurs daily when car is first started and reappears if car cools down for several hours after it has been driven. related to this problem is acceleration of vehicle. after gear finally engages, the slightest pressure on the gas pedal can send the car lurching forward quickly. the other day while backing out of the driveway and then placing car in drive, was almost hit by another car coming down the street that no doubt expected us to be moving. even though we had placed the car in drive, it went nowhere. lucky the other guys stopped in time or we would have been hit. this could be a real safety issue. we have reported these problems to dealer on two separate occasions but they have been unable to replicate them and nothing has been done to resolve our problem. *tr

 Tl* - the contact stated that no matter how far down she pushes the accelerator her vehicle will not go over 15 -20 mph. the contact stated that she has contacted the dealer approximately 6 times and she was told that they cannot do anything until the check engine light comes on. the contact says that the problem occurs occasionally and she does not know when it will happen.

 Dt*: the contact stated while moving forward from an idled position the vehicle jumped and remained in first gear while driving up to 20 mph on normal road conditions. there were no warning signal while the problem was present. the jumping problem occurred continually however the gear shifting problem has been intermittent. sometimes took ten minutes to shift and on other occasions as long as forty five minutes or more. the vehicle has been taken to the dealership several times but the diagnostic test would not indicate any abnormality. the dealership also mentioned the jumping problem was normal on all those hyundai models. the manufacturer was contacted who determined there was no recall on the vehicle.

 Initially (2) times there was no response from engine when gas pedal depressed, we have had 3-4 incidents of when stopped at intersection, or driving slowly in parking lot engine surges and breaks had to be applied severely to prevent car from hitting other cars, the last incident was the transmission would not shift from 1st gear and car would not go faster than 20 mph. all of these are safety issues. *nm

 The car lurches forward violently when the gas pedal is touched intermittenly. the defect seems to be related to relationships between engine temperature and outside temperature. the defect is most likely to take place when the vehicle has been driven for about 20 - 30 minutes, then allowed to sit for about 2 to 2-1/2 hrs when the outside temperature ia btween 68 and 74 degrees. the car was purchased march 21, 2005. i have almost 10,000 miles on it. the defect began on day one. i have a log file of starts since then. the dealer claims it is not a vehicle defect, it is the way i drive the car. i have an affidavid from another driver who experienced the same problem in the car on july 17 when i was not present.

 This is a brand new xg350. the defect started within the first week. when the car is first put in drive after turning on the engine, the car lurches forward with no control, enough to scare driver. after 4 visits he dealer cannot isolate the problem because it is intermittant. car is dangerous to drive
