I signed a 36 month lease contract and took delivery of a 2004 jaguar x-type from jaguar of novi on 3/15/04. at approximately 6,700 miles/3 months, the car began to experience a problem where the vehicle, when traveling at speed, will go into safe mode which causes the car to lurch and surge until it can be driven to the shoulder to turn the vehicle off. once restarted, the check engine light will come on but occasionally, will not stay on. the car was towed to jaguar of novi where it was repaired subsequent to this initial repair the vehicle has been taken back to the dealership, mostly via a tow truck a total of 14 times for the identical problem all of which are fully covered by the manufacturer warranty. i have taken legal action at this point and have signed an agreement for settlement under the consumer lemon law. the reason i am filing my complaint is this: my vehicle poses a safety issue. every time i am told by the dealership that my vehicle is repaired and ready to be picked up, i drive the car for 50 miles or less and the car goes into the safe mode and i am forced to abruptly get off the road or risk causing an accident. i continuously complained to the dealership, whose answer was, your vehicle is un-fixable. they state they can replace parts (which every time it is in, the parts list is numerous) but cannot pinpoint the problem, nor guarantee that the problem will not recur. at this point, i have picked up my vehicle, but am awaiting the date that jaguar cars will take my car back and settle my case. i am requesting that the issue be investigated, since i feel that my safety is compromised and they knowingly release my vehicle un-repaired. again, i am pursuing this case under the lemon law and would request that your investigation be performed in a manner that would not harm that case. *jb

I leased a new 2004 jaguar x type from shelton jaguar in naples, florida in late march. i noticed a shudder in the steering wheel and went into the dealership to report it. i spoke to the service manager on april 15th and he said that it was normal for this type of vehicle. later the same day, as i was turning left at an intersection, i heard a loud bang and it sounded like something dropped off the bottom of my vehicle. i stopped and looked under the car and saw a large piece of metal dragging from my car to the pavement. a policeman came along and made me move my car into a nearby parking lot. i did so with great reservations because the dragging metal was making sparks as i drove. when the policeman looked under my car in the parking lot, he said that the gas tank had fallen and was resting on the piece of metal that was dragging on the ground. i called jaguar roadside service and they sent a flatbed truck, who refused to load my car because it was too dangerous. the dealership was closed so jaguar told me to leave my vehicle in the parking lot and take a cab home, which i did. the next morning i called the dealership and they recovered my car. they repaired it but i wanted a new car as i was worried about the safety of driving this one. they refused to give me one. it was in their shop for a week and they had to replace the driveshaft as well as secure the brace for the gas tank. *la

Failure of the gas cap. the gas cap cannot be removed when adding gas. this is the second occurrence. the first time i was low on gas approx 2 gals remaining and we pulled in for gas and the gas cap would not unlatch. i had to break it off to put gas in the car but was not able to attached the cap. it happened on the weekend so it was 2 days before it was in for service. this occurrence was very similar, the cap feels like it wants to come off but it won't release. i had a half of tank this time and wanted to top off the tank. finally i broke the cap and the top broke off with the other part still in the tank. once again this happened on a saturday and the vehicle can't go in until monday or tuesday. *jb
