 The office of defects investigation (odi) opened dp09-001 on april 8, 2009, to evaluate a defect petition requesting additional investigation of potential throttle control system defects unrelated to floor mat interference with accelerator pedals in model year (my) 2007 lexus es 350 vehicles.the petitioner referenced an earlier odi investigation concerning floor mat interference with accelerator pedal return (pe07-016/ea07-010), which he stated was too narrow in scope as it did not include all incidents of unwanted acceleration and consider all potential causes of vehicle speed control concerns.the petition also requested an investigation of my 2002-2003 lexus es300 for those 'longer duration incidents involving uncontrollable acceleration where brake pedal application allegedly had no effect' that were determined not to be within the scope of investigation pe04-021. as background, the petitioner owns a my 2007 lexus es350 that allegedly experienced an unwanted and uncontrolled acceleration event (odi complaint number 10261660).toyota concluded that the incident was caused by an unsecured floor mat. to assess the petitioner's request, odi interviewed the petitioner, inspected his vehicle, reviewed information submitted by toyota, reviewed owner complaints alleging incidents of unwanted acceleration in the subject vehicles and material related to the investigations cited by the petitioner.odi identified 64 complaints alleging incidents of unwanted acceleration in my 2007 lexus vehicles, resulting in 8 crashes and 15 injuries.odi's analysis of these complaints determined that 50 (78%) involved incidents of floor mat interference, including 7 (88%) of the crashes and all 15 injuries.therefore, odi's analysis found that the only defect trend related to vehicle speed control in the subject vehicles involved the potential for accelerator pedals to become trapped near the floor by out-of-position or inappropriate floor mat installations. on october 5, 2009, toyota initiated a safety recall (recall 09v-388) to address concerns with potential accelerator pedal entrapment by floor mats in approximately 3.8 million vehicles, including the subject vehicles.except insofar as the petitioner's contentions relate to that recall, the factual bases of the petitioner's contentions that any further investigation is necessary are unsupported. in our view, additional investigation is unlikely to result in a finding that a defect related to motor vehicle safety exists or a nhtsa order for the notification and remedy of a safety-related defect, as alleged by the petitioner, at the conclusion of the requested investigation.therefore, in view of the need to allocate and prioritize nhtsa's limited resources to best accomplish the agency's safety mission, the petition is denied.this action does not constitute a finding by nhtsa that a safety-related defect does not exist.the agency will take further action if warranted by future circumstances.please see thefederal register notice for further details.

 The population number noted above is estimated.in the january 15th, 2004 petition request letter to the national highway traffic safety administration (nhtsa), the petitioner identified 37 voq complaints as related to vehicle speed control issues similar to those the petitioner allegedly experienced in their own vehicle on multiple occasions (as described in the petition request letter).during it's consideration of the request, the office of defects investigation (odi) reviewed the 37 complaints and concluded that 34 of the complaints did not involve a throttle control issue as described and alleged by the petitioner; three voqs (one of which is the petitioner's) do allege a throttle control issue.however, the throttle control issues alleged by the petitioner are similar to those alleged in the supporting voqs for preliminary evaluation pe04-021 which involves the throttle control system on model year 2002 and 2003 toyota camry and camry solara models.based on odi's review of available service information, it appears the throttle control system manufactured on the lexus es300 models is the same as, or similar to, the throttle control system used on the toyota camry and camry solara models.accordingly, the es300 models will be added to the scope of pe04-021 and the petition is granted.

 The lexus models were the subject of defect petition (dp) 04-003.twelve odi complaints are duplicative to toyota reports, including the two minor crashes.the v6 equipped solara models have been excluded because they do not contain the subject throttle control system.toyota introduced electronic throttle control (etc) on the subject vehicles beginning in model year (my) 2002.odi opened the investigation to determine if the system could be the cause of complaints alleging the engine speed increased, or failed to decrease, (for a short duration) when the accelerator pedal was not depressed (the alleged defect).during the course of the investigation, odi analyzed agency data and reviewed vehicle owner questionnaire (voq) reports, conducted interviews involving 113 voq and 36 toyota reports, inspected two complainant vehicles, reviewed relevant toyota service and new car feature documentation, reviewed and analyzed toyota

 On 9/4/2011 at approx. 1: 41 pm, i was pulling my 2003 lexus es300 (with my foot on the brake) into a shopping center parking space when it suddenly surged, then accelerated over the curb and onto a sidewalk where people were dining at tables. as the car accelerated over the curb, i pushed harder on the brake and tried to steer the car away from the diners. as the lexus goes over the curb and onto the sidewalk, the car continued to accelerate like it was being pulled, and the driver's side bumper hit a table of diners. three people are injured; one with compound fracture. the car continued to accelerate as i continued to push on the brake, trying to will this car to stop. it hit tables and chairs as people jumped out of the way of this runaway car! the car deflected off a building and came to a stop on the sidewalk. my foot was still on the brake. tire marks from the braking were visible on the curb and sidewalk as local news stations recorded and aired. airbags did not deploy. the weather and visibility were clear. around 10/4/2011, one month after the wreck, a toyota investigator inspected the car's accelerator pedal and found it operated smoothly and returned to its idle position withoutany binding or sticking...[it was] correctly aligned...no damage observed. the electrical connector was in place and secure....a diagnostic system check showed that there were no trouble codes relating to the operation of the vehicle. but my foot was on the brake. as of 3/12/2012: property damage: $20,000. lexus body damage:$9000. personal injuries: one settled, one countered, one talking with a personal injury lawyer. i no longer own the car. i was terrified to drive it.

 2003 es 300 - transmission issues: i have been experiencing hesitation upon acceleration almost every time, along with hard shifting 50% of the time. the acceleration hesitation can be scary if i'm trying to enter the highway, or turning left. the hard shifting feels like i got hit from behind. both problems have been going on for years and lexus dealer has never been any help. i read many of the online forums and found that both of these problems are very common as are their results for getting these issues fixed - not much luck from the dealer - it works as it is designed. really? lexus needs to stand behind their product. i can't believe how many complaints i have read (100s) and their hasn't been a recall. how does a consumer go about pushing for a recall, or class action or will the lemon law work?

 2003 lexus es300 with accelerator pedal, automatic transmission, and vehicle speed control issues. consumer states that the when trying to accelerate from a low speed there is a delay before the engine responds. *kb the consumer stated he experienced a significant abrupt downshift when slowing down from higher speeds and an abrupt upshift when accelerating from a slow speed. it felt as though the transmission could not decide what gear it should be in. the consumer was advised a computer patch was available for the problem, but it usually did not work and it could make the problem worse. *jb

 Tl*the contact owns a 2003 lexus es300. the contact was driving approximately 2-3 mph. the vehicle lunged forward and rear ended another vehicle. the vehicle continued to accelerate even after the crash occurred. there were no injuries. a police report was filed. the vehicle was inspected at the dealer, who was unable to diagnose the failure. a complaint was filed with the manufacturer. the vehicle has not been repaired at this time. the current mileage was 55,972. the failure mileage was 54,000.

 Tl* contact owns a 2003 lexus es300. while coasting toward an intersection at speeds of at least 10 mph, the vehicle abnormally accelerated at a rapid rate of speed. she was unable to maintain control of the unintended acceleration and the vehicle proceeded to veer toward a nearby wooded area. the vehicle crashed into approximately 3 trees before the vehicle came to a stop. as a result, she suffered unknown injuries. the vehicle had since been repaired. the failure mileage was 38,000 and the current was 39,000.

 Tl*the contact owns a 2003 lexus es300. the driver was driving in a parking lot approximately 10 mph when the vehicle began to accelerate on it's own. the vehicle accelerated above 80 mph which caused the driver to crash into 6 vehicles. the driver was injured and was taken to the emergency room. the police confirmed that the driver was traveling at 86 mph due to the uncontrollable acceleration. the contact was not aware that the vehicle had increased at that speed. the failure mileage was 35,000 and the current mileage is 41,000.

 Tl*the contact owns a 2003 lexus es300 purchased april 2004. she immediately began experiencing failures when the vehicle surged and violently lunged forward while it was idle. the dealer stated that the vehicle was a smart car and was aware when there was a driver, other than herself behind the wheel, which would confuse the vehicle. no diagnostic test were performed. the failure progressed and the vehicle was taken back to dealer a second time. although the dealer became familiar with the failure; they stated that she needed to wait a year until the new programming was available. one year later, the vehicle was taken back to the dealer for the software reprogramming and the failure became progressively worse. the vehicle continued to lunge violently while sitting idle, driving at speeds of under 35 mph or while coasting. when the vehicle lunged it felt as if she was being struck from the rear by another vehicle. there were no additional repairs made to the vehicle. the vin was not available. the failure and current mileages were approximately 78,000.

 My 17 year old daughter was driving my 2003 lexus in town. we have never had any previous similar incidents, and have not experienced the same thing since. she had stopped at a stop light, but was too far back, so she wanted to pull up a little. she took her foot off the brake, and the car moved forward. she repeatedly pushed the brake, but they did not work. the car stopped when she hit the car in front of her. i had the car checked after the accident, but they couldn't find anything obvious. however, she, and the other passengers, have verified that she repeatedly pushed the brake to no avail. *tr

 I was in the drive through at the dunkin donuts in germantown, md giving my order in the speaker. i remember hearing a roaring sound like a train and the next thing i know all of a sudden my car shot forward and hit the back of the car at the service window. it was quite strange. i am convinced i had my foot on the brake. the ems and police said i must have hit the accelerator by mistake. i am not convinced in my own mind that this is what happened. *tr

 Since i purchased the car, i have been complaining about a hesitation and stuttering when accelerating after a slow-down or a stop. i was told there was nothing wrong several times and more recently have been told it is a design flaw in the computer-controlled accelerator and cannot be fixed. i have several times had a close call on the freeway when i needed to accelerate quickly and the car hesitated before accelerating. i have not had an accident, but have been very frightened by the delay in performance. i have had 2 previous lexus es 300's that did not have this problem. *nm

 As i was pulling into a parking space, my 2003 lexus es suddenly accelerated and went over the curb and a small grass embankment. i immediately applied brakes and it did start slowing down. i finally got the car stopped. thankfully no one was in that parking lot. don't know what damage has been done to the car. this is frightening because there was absolutely no control over the car.

 On jan 20, 2005 at about 7:30pm i was returning from work driving my lexus 2003. just before reaching my home, i turned right into notley road from stone gate drive at silver spring, md after stopping at the stop sign. before i realized, the car knocked over the mail box of the house on the right side and started racing on the yard of the house. next the car knocked down the street light, crossed a road and raced towards a tree. although i applied, the brakes were not working. ultimotely the car crashed on to a tree, turned over and i was lucky enough to crawl out of the car with much effort. i was taken to the montgomery county general hospital by ambulance and after being examined by the physician and xrays i was released. the car was ultimately towed to lexus body shop and was pronounced a total loss i feel that the lexus took off on its own when i turned right from a stop sign into the notley road damaging propery and ultimoately crashing on to a tree. because there was snow on the yard, i was able to videotape the track marks made by the car from the beginning to the end of the crash. i hope that you will investigate this incident and give me some report.*ak

(this felt as if the transmission slipped then the surging occurred) there was an annoying rattle in the ceiling console. *sc

 Vehicle hesitated from a standing start position. the rpms went up but the vehicle did not move until it got into another gear. it will drive for a while and then vehicle will stop. consumer did not feel safe. *ak the technicians claim that the cable from the gas peddle to the engine was removed and replaced by a computer in the 2003 models. on the highway, if the vehicle was slowed down, a hesitation would be present while pressing on the gas peddle to resume speed. the engine light would come on along with the hesitation, also when the engine light would come on the vehicle would lose power along with blue smoke blowing out of the exhaust, and the rear seat contained a flaw. *sc *jb

 There is a dangerous and unpredictable tendency for the vehicle engine/transmission combination to accelerate suddenly and unexpectedly. this is an intermittent problem which makes it especially unnerving. it is most noticeable at speeds below 40 mph, when first slowing, followed by acceleration. it appears to be exacerbate by uncertain transmission hunting for proper gear/engine speed combinations. the sudden acceleration causes a rapid and jerky throttle response to mild accelerator pedal input. i have taken the car to the dealer on at least two occasions for this issue. the first time, the dealer reprogrammed the transmission. the second time, the technician tested the vehicle and note no problem found. at current mileage of 32,000, the problem seems to be worsening. this is a dangerous condition that, if left undressed, is likely to be the cause of an accident, serious injury or much worse. *jb

 When making as low turn, at under 5 miles per hour if the accelerator is depressed there is a significant lag before the car reacts and moves. dealer claims that is the way it is an can't fix it. also happened with a 2007 lexus es 350 as a dealer loaner and this time resulted in an accident with $3,700 damage to lexus. *tr

 While driving at 70 mph in the fast lane on the freeway, my car suddenly lost acceleration and the check engine light came on. i was able to get my car to the right and get off the freeway to a gas station. as i was slowing to a stop, the car was shuddering before it came to a complete stop. i checked the owners manual and it said it was probably the electronic throttle control. i followed the instructions in the manual and was able to drive the car at lower speed to get home and then get it to the dealer the next morning.*jb

 I have now sent my car in for service twice to lexus of orlando about unexpected surging of the vehicle and vehicle hesitation when the accelerator is pressed. this is an intermittent and dangerous problem, as i do not know when it will occur. when it does occur the upshift is harsh, the downshift delayed as if the transmission is confused about the driver's intention, and there is pronounced hesitation when the accelerator is pressed. this lack of responsiveness leaves both the vehicle and passengers exposed to accident and injury. on my first visit, i was told the vehicle computer would be reset, as the vehicle learns your driving style in the first 30 or so miles, and i must have driven the vehicle harshly. this so called reset did nothing to fix the problem; less than a week later, i narrowly escaped a crash after my car hesitated while crossing an intersection. i promptly returned the vehicle to the dealer for service. upon completion of the second service, which included a drive with the technician, lexus service now says these problems are inherent to the model and they can't fix them. in addition, i am aware that numerous owners frequently complain of hesitation and surging in 2002, 2003, and 2004 models and many complaints (over 100) of the same nature have been filed with the nhtsa. this statement is to issue notice that i am not satisfied, and the problem has not been fixed.*ak

 Ongoing and worsening lack of accelleration predictability. car will hesitate especially when power is required (such as merging traffic, left turns, etc.) automatic ransmission sounds like it delays engaging when necessary.*ak

 Upon stopping, and when consumer removed foot from the gas pedal vehicle surged forward before the brake pedal was depressed. this occurred numerous times. once, resulting in consumer's vehicle crashing into a concrete pole while pulling into a parking lot. also, starting at 5000 miles battery had to be replaced 3 times because it died. this was due to an electrical short. *ak *la
