Both the petiton for rulemaking, defect, and noncompliance order, and the petiton for hearing on notification and remedy are denied.the agency has determined that both petitions are moot given that the manufacturer decided there was a safety defect in its motorcycles and issued owner and dealer notifications and supplied a free remedy where needed.a copy of the published notice further explaining this decision can be found in the notice of denial document in this file.

The motorcycle will not go in fourth gear.. it jerks and has a bad noise coming from the transmission when in fourth gear. i understand that there was a recall on this problem. when i called victory, i was told the bike had the new redesigned transmission. hilltop cycle of wytheville va. said it was scheduled by the owner to have the transmission replaced. but decided not to at the last minute. i bought the motorcycle from hilltop cycle of wytheville va. with no knowledge of this problem, nor was i made aware of it by [xxx] (owner of hilltop) who sold me the bike!!!! it is a miracle that i wasn't killed on the interstate, had the transmission locked up, locking up the back tire. how can you be allowed to do this to consumers??? victory aware of the problem, redesigned the transmission in 2001. but mine still has the old one in it!!! which is very unsafe and dangerous..... i was quoted a price for a new one by hilltop cycle for $2,700 i dropped the bike off may 5th 2012 picked it up today july 14, 2012 was finally told after over 2 months... that they could not fine one for it..really????? this takes over 2 months to tell me this, after i had inquired about the bike several times. great service..... so how do i get victory's mess fixed now??? information redacted pursuant to the freedom of information act (foia), 5 u.s.c. 552(b)(6). *tr

Tl*the contact owns a 2000 victory v92c motorcycle. while driving approximately 40 mph, the transmission made a loud grinding noise and the vehicle vibrated excessively. the driver pulled over to the side of the road and inspected underneath the hood. he checked the oil level and metal shavings were found on the dip stick. roadside assistance was called to the scene and the vehicle was towed to his residence. the authorized dealer referenced nhtsa campaign id numbers 06v298000 and 06v303000 (power train:manual transmission). the contact failed to receive a safety recall notice. the vehicle was damaged as a result of the failures. the authorized dealer will perform the recall repairs; however, they refuse to repair the damages associated with the failures. the vehicle is currently being repaired. the vin was unknown. the failure and current mileages were 10,050.

Dt*: the contact stated while driving various speeds on the highway, the manual transmission slipped gear and down shifted which caused the motorcycle to operate at a reduced speed without warning. the dealer and manufacturer were alerted and agreed the vehicle was included in nhtsa recall, # 06v298000, concerning manual transmission. however, both refuse to repair the vehicle without charge. the manufacturer offered to cover half the cost of the recall repair as part of a customer satisfaction program.

The front sprocket nut on my 2000 victory 92c motorcycle and it's retaining clip fell off. i took it to the dealer and they charged me $196 to put a new nut and retaining clip on. today, i learned that your recall 06v303000 covers the replacement of the sprocket assembly due to a defect with the retaining clip. my sprocket was damaged beyond repair but wasn't replaced by the dealer. he says his mechanic missed it. today my dealer called victory, spoke with john. victory stated that they would not repair my bike under the recall but would not state why. they would not tell the dealer whether my vin is on the recall list or not. they just said they would bear no responsibility at this time. *nm

The transmission on my victory (polaris) 2000 92c motorcycle failed yesterday. first indications were difficulty in locating the neutral gear, followed by seeing the neutral light come on between 2nd and 3rd gear and it slipping between gears. then my 3rd gear failed to engage a few times. now the transmission appears to be shot and it sounds like my bike is full of gravel, very noisy metal grinding sounds. bike is going to have to go to the shop. a recall on this is in order. please. *jb

I currently own a victory v92c motorcycle made by polaris industries. this motorcycle has 7000 mile on the odometer and has started to experience increasing frequency of shift problems over the last year. i am currently experiencing about one shift failure every 25 miles of operation this failure usually consists of the transmission shifting into a position of neutral when shifting between second and third gears. i have experienced a more dangerous condition recently that is the transmission will downshift from third to second when under a load such as accelerating into traffic at an expressway on ramp. this results in an overreving of the engine and a dramatic slowing down of the motorcycle which when it occurs requires the driver to react to avoid a crash. i have delivered the motorcycle to a dealer to have the transmission repaired that is where i heard about the investigation being done by the nhtsa. *nm

I own a 2000 victory v92c motorcycle (vin: 5vpcb15lxy3001734) that is beginning to develop transmission problems. during a 90-mile (rt) ride from my home to work on 08/13/2005, i had difficulty shifting out of neutral after sitting at intersections along the route. this occurred during the entire trip on that day and has been occurring with more frequency. the motorcycle only has 8,500 miles on it, and is maintained consistently by the owner. other victory owners have experienced similar transmission shifting problems, but i am not aware if polaris has diligently attempted to address them. in addition to the out-of-neutral shifting problem, i have broken down twice due to the transmission output shaft shearing the spline teeth completely off the front drive sprocket. this is due to an incorrect shaft threading engineering flaw that also needs to be addressed. the drive belt is located on the right side, the belt rotation is clockwise, and the transmission output shaft is right hand threaded. the lock nut that hold the front sprocket stationary on the transmission output shaft loosens up overtime due to the jarring of the drive belt under load. if the output shaft were replaced (along with a transmission upgrade to address the shifting difficulty) with a left hand threaded shaft this problem would never exist, the retaining nut would continually self-tighten itself on the shaft threads. these two drive train problems present a major driving risk and renders the motorcycle less reliable, if not unsafe all together. as a consequence, over the last several years, i have ridden it less frequently; when my initial intent was to ride it 9-10 months out of the year for commute reasons. now it sits in my garage collecting dust. *nm

My transmission slips out of 3rd back into 2nd, also there is sometimes a false neutral between these gears, at first it was once a day, now it's several times in a hundred mile ride. i spoke with my dealer, he immediately called victory and they told him they had no knowledge of a tranny prolblem, but would let him investigate. if anything was found to be a flaw they'd take care of the parts, if nothing was found i was on my own.( meaning i had to pay for the bill for the whole thing parts and labor. i noted my first time i remembered it acting up as my incident date.

I own a 2000 polaris victory. over the last year that i have owned the bike i have experienced many different issues that alarm me about the transmission. i have brought this to the attention of polaris mechanics and the only response that i receive, is that this was the way the 99 and 00 transmissions were. i am alarmed to drive my bike because of these issues. some of the issues consists of slipping in between gears while up shifting and more so while i am downshifting. also locking in between gears while downshifting. not being able to get it into gear while sitting at a stop light. i have to slam the transmission into second then slam it back down to get it into first. this is a huge issue that i feel polaris should be addressing more then what they have. i ask of you to please check into this issue and let me know what you guys have found. i know i am not the only person experiencing problems with this year. being on two wheels the thought of transmission failure is not a pleasant thought. *jb

(2)transmission missed shifts and continually poped out of gear. transmission began leaking oil at rear pulley appearantly due to an improperly torqued retainer nut. upon dissasembly of the transmission, there was obvious damage to shift forks and shift dogs on some of the gears. (3) dealer arranged to have the parts supplied by victory while i paid for the labor to install the parts. the cost to me was approximatly $1000. the bike was out of warranty by over 1 year when the failure occurred. *ak

1: my motorcycle transmission has been having troubles for a couple of years now. nothing traumatic happened to cause this to happen, its' just a design flaw. major design changes were made after the 2000 models to prevent these problems.*ak 2: at first i was mainly getting false nuetrals. most of my problems are between second and third gear. sometimes it would just go between the gears and not into one. the next problem came when it started coming out of third gear and into the false nuetral. this fall it has on two occasions shifted of it's own accord from third gear down into second. this is by far the more dangerous of the problems and utterly terrifying. 3: my dealer at one point replaced something called the shift detent mechanism. for a time this seemed to help. transmissions in years after mine were redesigned to deal with this problem.

Motorcycle transmission will find a false neutral between second and third gears. also pops out of third gear on occasion. can create a very hazardous condition, injury, death if the transmission fails or pops out of gear at a critical time. dealer has been notified multiple times and even test rode the machine, but didn't experience any problems. they told me that only in the event of a failure would they fix the transmission. at the time my motorcycle was under an extended warranty. i believe that warranty has since expired.*ak

Polaris industries makes victory motorcycles. i have a 2000 victory cruiser v92c. the drive sprocket splines shear totally disabling the motorcycle. when this happens you have no power and this could cause a serious accident or death because of this major failure. polaris is aware of this problem, has issued a service bulletin, but does not check the motorcycles for this problem when the bike is getting serviced. i believe there is approximately a 5% failure rate which on a motorcycle reduces your odds substantially. the new transmission kits have corrected this problem with finer threads and locktite to hold this sprocket on. i believe this is a serious failure and should be corrected by polaris before someone is killed on the road when this happens. *nlm

I own a 2000 victory v92c. it has suffered several problems, all that have been dealt with by victory in a timely fashion, but i feel that it is necessary to report this matter to you because other victory owners have experienced similar issues. the nhtsa was instrumental in causing a recall for the fuel pump, of which i suffered one failure. victory replaced that original pump without question. my main area of concern is the original transmission. on 7/26/01, the front drive sprocket was replaced after it spun on while i was on a tour, with just over 15,000 miles on the bike. on 8/24/02, my local dealer noted that the front drive sprocket had again worn out, at just over 31,000 miles. by 9/24/02, victory had replaced my entire transmission. my area of concern is that i have seen several victory motorcycles from 1999 and 2000 that have been replaced (there was a change in design in 2001, which seems to have fixed the problem) due to similar transmission issues. this is something that the nhtsa should look into. *nlm
03/09/20033500110/13/2000
Motorcycle transmission often misses shift from 2nd to 3rd gear, hitting a false neutral. also, the transmission has, on occasion, jumped from 3rd gear back to 2nd after shifting to 3rd, creating a dangerous situation where the rider could be thrown forward off the motorcycle (though i have not been thrown off yet). the march 9 date indicates the latest incident of a missed shift into 3rd gear. *jb
